Areas of Law / Divorce and Family

An elderly aunt has been in a nursing home for six years. We have run all her errands and looked after her financial affairs. Recently she told us she has made a will leaving her home to the church, and we now wish to pass on our duties to someone else. How do we go about this?

You should return all the documents in your possession to your aunt and inform her of your decision. If she is in no fit state to appoint someone else to deal with them it’s possible she was not of sound mind when she made her will and you would be advised to raise this with her GP. It’s possible some of the proceeds from the sale of her home will be required to pay the nursing home fees.
