I am allergic to onions, but on a recent visit to a local restaurant I was served a pasta dish with onions in even though I checked three times to ensure it was onion-free! When the dish arrived I had one spoonful and was very sick. The restaurant referred my complaint to their solicitors who, on learning that I wasn’t hospitalised, decided there was no claim to answer.

You’d think the restaurant would have offered you a token sum if only for your disappointment, and you certainly shouldn’t rely on the defendant’s solicitors to decide whether or not you have a valid claim! However unless you were very ill and had to take time off work for example, any compensation you might expect to receive for the restaurant’s negligence would be for disappointment only and likely to be minimal. Give them a bad review online.
