Areas of Law / Employment

I hurt my elbow at work, but the firm keeps moving me to a job that involves heavy lifting and means that I end up going off sick. I have been trying to resolve this via company procedure for three years without any success. Do I have to keep going through company procedure or can I take them to a tribunal?

It sounds very much as though you’re being taken off your original job to work elsewhere, which could mean there’s been a breach of your employment contract. Although you are entitled to ask for lighter work, you may have more success proving breach of contract at a tribunal. I suggest you see a solicitor however, since you may also have a claim for compensation from the firm for your initial injury.
