Areas of Law / Insurance law

I was involved in a car accident, and took the car to the garage appointed by my insurance company to be repaired. The garage rang me to say that the car was a “total loss”; then two days later they rang me again to say it was going to be repaired. I’ve refused to take the car back until they’ve sorted out how much they’ll pay me if the car is written off. What’s my legal position?

I don’t think you’ll have a choice between having the car repaired and taking the money. Check the terms and conditions of your insurance policy. It’s almost certain that the insurance company will have the right to decide whether or not to repair the vehicle. However you are entitled to expect that the vehicle will be returned to you restored to the condition it was in prior to the accident.
