I work for a nursing agency on call every night. We were told we are exempt from the minimum wage legislation because we’re on call and working from home. Could you advise?
All workers are entitled to be paid at least the minimum wage for every hour actually worked. In your situation (as from last October 1st) you must get at least £6.31 for every hour that the agency asks you to work, but you are not entitled to the minimum wage for any hours when you are at home waiting for a call. If you are paid some kind of on call allowance, or a retainer to recognise that you are available for work, this must be paid in addition to the minimum wage.
