Areas of Law / Wills and Probate

My 96-year-old mother made a will many years ago naming the solicitor as executor. His firm closed down and we have no idea where he is now. What will happen when she dies? She has no property or valuables, but has a bank account with £10,000 in it. The bank allows me to deal with her account as she is housebound.

The bank may well release a comparatively small amount such as this to you on production of your mother’s death certificate. You could discuss what the bank’s policy is on this now. Failing that, if you have the original will it would cost very little to draw up a new one. Otherwise you will have to provide evidence of an attempt to find the missing executor in order to be granted authority to administer your mother’s estate.
