My mother-in-law is in a home. She made a will dividing everything between her three children, but now my wife’s younger brother has taken her to a solicitor to draw up a new will. We don’t know what it contains, but we suspect it will benefit the brother alone. Is there anything we can do about this?

The only thing to be done at this stage is for the other two children to have a quiet word with their mother. It’s possible she would be prepared to discuss the will and if necessary she could make yet another will. As things stand, any questions you have about her mental capacity or undue influence could only be raised after her death, when the will comes into effect. If it was drawn up by an experienced solicitor it may be very difficult to challenge it.
