Areas of Law / Divorce and Family

My partner has lived with me for four years but is not divorced from his wife. They reached agreement about their house, car and furniture, and my partner received an £8,000 settlement. His mother has died recently; will his wife be entitled to any of his inheritance?

If your partner isn’t divorced he will have no “final order” which would rule out any further claim by his wife on his money or possessions, so she could still in theory demand a share of your partner’s inheritance. Depending on the initial settlement and on whether the couple have any children and whether your partner pays maintenance it could be that the wife’s claim will not be very strong. But your partner should see a solicitor about obtaining a divorce as soon as possible.
