Areas of Law / Insurance law

My wife and I were involved in a road accident while holidaying in Italy last year. We have a form from the Italian police saying the other driver was at fault and we have the driver’s full details. However his insurers are being difficult by not answering emails or ‘phone calls. How can we make any progress in the circumstances?

Under European law it is possible to issue proceedings direct against the insurers of a driver who has caused an accident. Your own insurers should be dealing with this for you, but if necessary there is an Italian equivalent of the UK’s Financial Ombudsman Service you could complain to about the conduct of an insurance company. The Italian Embassy may be able to point you in the right direction.
