We were recently transferred to a different company and lost the benefits of a life insurance scheme and profit-related pay. These benefits are still enjoyed by the people who still work for our previous employer – about half the original workforce. Aren’t our previous and present employers breaking the law by doing this?

Under the Transfer of Undertakings regulations your employment contracts are also transferred to the new owner along with the business. This means you should enjoy the same working conditions as you did previously. However the regulations are quite complicated, so you should consult a solicitor or your trade union representative to see, firstly whether the transfer is covered by the legislation, and secondly, how it applies to you in practice.
