Property Questions

I have recently received an order from the council seeking possession of my council house. I owe just under £1,000 in rent arrears. My local advice centre says there will be a duty solicitor in court. Is this correct?

The lease on my flat has some 69 years of a 99-year lease to run. Since I am 72 the length of the lease doesn’’t concern me unduly, but I have left the property to my daughter and wonder whether she will be able to extend the lease or buy the freehold.

The roots of a tree on council land at the side of my bungalow are lifting the tarmac on my drive and could be damaging the drains below. 18 months ago the council agreed the tree should come down, but nothing’s been done despite numerous letters and phone calls from me.

Our next door neighbour has put in a planning application to build an extension to the front of his property less than 4ft away from our front window. This will not only take light from our living room but block our view and reduce the value of our house.

My neighbour has a maple tree on the boundary which is full of mildew and which damages my own plants and my lawn. I have discussed this with her amicably, but she refuses to cut the tree down. This year the problem is worse than ever, is there anything I can do to prevent further destruction of my garden?

Our garden is overshadowed by the massive branches of two trees belonging to our neighbour. I understand I can cut these branches where they overlap the boundary, but that I have to offer the wood to my neighbour. Does the cost have to be met by me, or jointly with my neighbour?

A neighbour whose outbuilding backs on to my field has fixed his drain pipe so that the water from the roof discharges on to my land. Has he any right to direct rainwater on to my property, and what action should I take?

A new neighbour habitually parks his car in front of our garage and we have to ask him to move it every time we want to get the car out, is there anything I can do about it? The lane to the garage is a pedestrian right of way maintained but not owned by the council.

We have been renting a small garden plot at the back of our property for £25 a year. The land has just been sold and the new owner is proposing to charge us £500 a year to include a parking space and with the option to buy in 12 months’ time. Can he increase the rent by this amount?
