I left my job, but have since received a letter from my employers asking me to send them a cheque for £150 which they say is overpaid holiday pay. They say I’d accrued 14 days’ holiday pay but had actually taken 18 days. Do I have to pay this?
Only if there’s something in your employment contract that says you have to! Since everyone is entitled by law to a minimum of 5.6 weeks’ paid holidays a year it means it’s possible to take your holidays before you’ve put in the hours to earn them. Most employers have updated workers’ employment contracts to allow them to claw this money back from employees who leave having taken holidays they haven’t earned. However some employers haven’t, so check your contract.
