I recently retired from a job where I’d worked for eight years. I had only one pay rise in that time while everyone else had annual increases. My boss apparently said that he could count on me staying because I’d struggle to get another job at my age. Would I have had any legal basis for demanding the same pay increases as my colleagues?
It’s unlawful to discriminate against workers by reason of their age, so you could have sought compensation if you were able to prove that was why you were paid less. If your treatment caused you to leave this could have given rise to a further compensation claim. However you would have been advised to use the formal grievance procedures in an attempt to resolve these issues before handing in your notice. It’s very difficult to win a constructive dismissal claim otherwise.
