Areas of Law / Bankruptcy Debt

My husband was recently declared bankrupt and since all his assets including bank accounts were in his sole name, they have been seized by the trustee. We have been married for over 50 years, so should I not be entitled to a share of his assets as I would be on divorce?

Unfortunately since his bankruptcy your husband I take it has no assets to share. You don’’t mention your home, which you will probably have at least a 50% stake in, and perhaps more depending on how you purchased it. If your husband took out loans against it these should be set against his share, not yours. Bankruptcy is a drastic step which can sometimes be avoided with timely advice. You should take independent advice at this stage.
