Areas of Law / Wills and Probate

My sister and her boyfriend have been together for two years living in her house. If my sister dies before her partner, will he inherit everything? He has no family, but my sister has children and grandchildren.

He won’t actually inherit anything unless your sister has made a will in his favour. But under the Law Reform (Succession) Act 1995 couples who have lived together for at least two years have a right to make a claim against the estate of a deceased partner. However in order to establish such a claim the boyfriend might have to go to court, unless an agreement could be reached within the family. It’s unlikely that your sister would want to set her boyfriend against her children in this way after she dies. Hopefully she will make a will after discussing the issue with those concerned.
