Areas of Law / Wills and Probate

I was divorcing my husband when he died. We owned a house together, but it emerged that my solicitor had sent my husband a notice dividing ownership of the house, which he had duly signed. Does the house now belong to me?

It depends whether your husband made a will leaving his share of the house to someone else. If he didn’t, and you were still married at the date of his death, it’s likely that you will receive his share of the house under intestacy laws in any case. If he did leave his share to someone else the situation is more difficult. You are entitled to reasonable provision from your late husband’s estate, but whether you will be entitled to his share of the house will depend on what else he left you.
