Areas of Law / Divorce and Family

Our daughter has split up with her husband. They have a four-year-old son. It’s been very acrimonious but the father has kept in regular contact with his son and now wants to take the boy abroad to visit his grandparents. What can we do to ensure that he brings the boy back?

If the country is a signatory to the European Hague Convention it means that anyone with a court order in one country should be able to enforce it in another member country through the embassy based there. Your daughter should therefore at least ensure that she has an order stating that the boy is to live with her before allowing him to leave the country. There are other things she could do, but nothing will actually guarantee that the father will bring the child back.
