Areas of Law / Debt matter

I jointly own a property, but my ex-partner was made bankrupt and a bankruptcy order was placed on the house a year ago. Will this order be removed if he is now discharged, or will they still be entitled to my ex-partner’s share when the house is sold?

You were quite fortunate not to have been evicted at the time, since although the court has some discretion it will normally give possession to the trustee in bankruptcy other than in exceptional circumstances. Although your ex-partner has probably now been discharged, he cannot reclaim any of the property that was seized at the time, and the order regarding your house will remain until the house is sold. If at all possible you should consider negotiating to buy your ex-partner’s share from the trustee at a discount.
